{"id":1030,"date":"2018-08-06T15:52:23","date_gmt":"2018-08-06T15:52:23","guid":{"rendered":"http:\/\/uol-law-tutors.com\/?page_id=1030"},"modified":"2025-10-02T12:55:31","modified_gmt":"2025-10-02T12:55:31","slug":"western-european-legal-history","status":"publish","type":"page","link":"https:\/\/uol-law-tutors.com\/index.php\/western-european-legal-history\/","title":{"rendered":"Western European Legal History"},"content":{"rendered":"<p><span style=\"color: #ff0000;\"><strong>Contact Us <span style=\"color: #000000;\">info @ uol-law-tutors.com<\/span> For Class Times And\/Or One-On-One Lessons.<\/strong><\/span><\/p>\n<p>This course is about the history of legal development in Europe, from the fall of the Roman Empire right up to the modern times.<\/p>\n<p>The focus is on broader themes of legal development &#8212; in particular, considering the emergence and evolution of various schools of legal thought, such as the humanists, the scholastics and the natural law theorists, and the influence these schools have had upon the individual legal systems of Europe.<\/p>\n<p>Most legal systems are derived from one or other of the great legal systems that developed in Europe from around the 11<sup>th<\/sup> and 12<sup>th<\/sup> centuries.<\/p>\n<p>In this course, we seek to outline the change in Ius Commune, or European Common law, in different times and places. Throughout, we will compare and contrast the development of legal systems within individual countries, in an effort to explain how each legal systems experience reflected the broader trends of the European legal tradition.<\/p>\n<h3>Module A: The Foundation: Roman and Canon Law 500-1100<\/h3>\n<p><strong>LWM50A<\/strong><\/p>\n<ul>\n<li>The\u00a0<em>Corpus Juris Civilis<\/em>\u00a0and its survival until the eleventh century<\/li>\n<li>Roman law outside the Justinianic tradition: Visigothic and Frankish law<\/li>\n<li>The Canon law in the West: Canon law collections before Gratian<\/li>\n<li>Feudal law and Roman law in Italy<\/li>\n<li>The revival of the study of Roman law<\/li>\n<\/ul>\n<h3>Module B: Interactions of Roman and Local Law: Twelfth-Sixteenth Centuries<\/h3>\n<p><strong>LWM50B<\/strong><\/p>\n<ul>\n<li>Gratian and the formation of the learned Canon law<\/li>\n<li>The consolidation of Roman law: the Glossators<\/li>\n<li>The expansion of Roman law: the Commentators<\/li>\n<li>Canon law scholarship, practice and influence<\/li>\n<li>Roman law and political thought<\/li>\n<\/ul>\n<h3>Module C: National Laws and Codification: Sixteenth-Nineteenth Centuries<\/h3>\n<p><strong>LWM50C<\/strong><\/p>\n<ul>\n<li>The renaissance of Roman law: humanism in Rome and France<\/li>\n<li>The droit \u00e9crit and droit coutumier in France<\/li>\n<li>Mos italicus and mos gallicus<\/li>\n<li>The reception in Germany<\/li>\n<li>The Dutch elegant school and the Natural Law movement<\/li>\n<\/ul>\n<h3>Module D: Modern Perspectives On the Ius Commune<\/h3>\n<p><strong>LWM50D<\/strong><\/p>\n<ul>\n<li>Early Natural law codifications<\/li>\n<li>Codification in France and its empire<\/li>\n<li>German romanticism: Savigny vs Thibault<\/li>\n<li>Pandektenrecht and Mommsen: German codification and scholarly reaction in Roman law<\/li>\n<li>Survival and continuity<br \/>\n-Andorra, San Marino and the Channel Islands<br \/>\n-Scottish amalgam of feudal and Roman law<br \/>\n-South African blend of Common law procedure and\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0Roman law substance<\/li>\n<\/ul>\n<h3>Assessment<\/h3>\n<p>Each module will be assessed by a 45-minute unseen written examination.<\/p>\n<h3>Sequence<\/h3>\n<p>Module A first has to be completed first.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Contact Us info @ uol-law-tutors.com For Class Times And\/Or One-On-One Lessons.
